What is mediation?
Mediation is an alternative dispute resolution method by which an impartial third person (serving as the mediator) facilitates communication between and among those experiencing conflict. The goal of mediation is to attempt to promote reconciliation, settlement or understanding. Critical to the success of the mediation process is the open nature of the communications and the confidentiality of all matters discussed during the mediation.
Mediation can be utilized as a dispute resolution tool by any individuals, companies, and/or organizations experiencing conflict. Parties may choose to mediate prior to or instead of bringing a lawsuit, or they may mediate after a lawsuit has been filed in an attempt to reach a settlement. Mediation can be especially helpful as a method of dispute resolution for those who have an ongoing relationship, such as relatives, neighbors, landlords and tenants, employees and employers, and merchants and consumers.
What is the mediator's role?
It is the mediator's obligation, as a neutral third party, to encourage and assist the parties in conflict to reach a settlement of their dispute. Such participation by the mediator encourages voluntary resolution of disputes.
